Zgoda na rozpowszechnianie wizerunku oraz głosu w Europejskim Webinarium Metropolitalnym

Biorąc czynny udział w I Europejskim Webinarium Metropolitalnym, organizowanym przez Górnośląsko-Zagłębiowską Metropolię (dalej: GZM), wyrażam zgodę na bezpłatne rozpowszechnianie przez GZM mojego wizerunku oraz głosu utrwalonego w materiale audio-wideo w ramach I Europejskiego Webinarium Metropolitalnego poprzez jego umieszczenie na stronie internetowej www.metropoliagzm.pl, na portalach społecznościowych oraz na kanale YouTube.

2.Jednocześnie oświadczam, że zostałem/am poinformowany, iż prawa autorskie majątkowe do materiału audio-wideo, który zostanie zarejestrowany w trakcie I Europejskiego Webinarium Metropolitalnego przez GZM, przysługują GZM na wszystkich znanych polach eksploatacji, w szczególności w zakresie: 

a)utrwalenia,

b)zwielokrotniania,

c)wprowadzania do obrotu,

d)wprowadzania do pamięci komputera,

e)publicznego wykonania, albo publicznego odtworzenia,

f)wyświetlania,

g)udzielania licencji na wykorzystanie,

h)upowszechniania w sieci internetowej i innych mediach,

i)posługiwania się materiałem wideo na potrzeby działalności promocyjnej GZM, co obejmuje prawo do zapisywania na nośnikach cyfrowych.

3.Jednocześnie udzielam GZM, bez dodatkowego wynagrodzenia, zgody na wykonywanie autorskiego prawa zależnego do wykorzystywania wybranych fragmentów nagranego materiału, w którym będzie wykorzystany mój wizerunek i głos.

4.Wyrażam zgodę na montaż, przemontowanie i wykorzystanie fragmentów nagranego materiału audio-wideo, w którym będzie wykorzystany mój wizerunek i głos.

A consent to disseminate image and voice during the 1st European Metropolitan Webinar

1. By taking active part in the 1st European Metropolitan Webinar organized by Górnośląsko-Zagłębiowska Metropolia [EN: Metropolis GZM] (hereinafter referred to as GZM), I give my consent to the free of charge dissemination of my image and voice by GZM, recorded in audio and visual materials, as part of the 1st European Metropolitan Webinar, by publishing it at the www.metropoliagzm.pl website, in GZM's social media profiles and on its YouTube channel.
2. I also declare that I have been informed that the proprietary copyright related to audio and video material recorded by GZM during the 1^st European Metropolitan Webinar is held by GZM, in any type of exploitation and particularly in relation to:

1. recording,
2. reproducing,
3. marketing,
4. saving in computer memories,
5. public rendition or public playing,
6. displaying,
7. granting licence to use,
8. disseminating in the Internet and other media,
9. using the video material for the purpose of GZM's promotional activity, including the right to record it in digital media.

3. I also give my consent to GZM, without any additional fee, to exercise the derivative copyright to use the chosen elements of recorded materials, in which my image and voice will be used.

4. I give my consent to editing, re-editing of elements of the recorded audio and video material, where my image and voice will be used.

Informacja dotycząca przetwarzania danych osobowych

Zgodnie z art. 13 ust. 1 i ust. 2 Rozporządzenia Parlamentu Europejskiego I Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (zwanym dalej rozporządzeniem 2016/679) informujemy, iż:

1) Administratorem Pani/Pana danych osobowych jest Przewodniczący Zarządu Górnośląsko-Zagłębiowskiej Metropolii (Przewodniczący GZM), z siedzibą przy ul. Barbary 21A, 40-053 Katowice, adres email: [email protected], strona internetowa: bip.metropoliagzm.pl.

2) Została wyznaczona osoba do kontaktu w sprawie przetwarzania danych osobowych - inspektor ochrony danych. Adres e-mail: [email protected], pozostałe dane teleadresowe takie jak powyżej.

3) Pani/Pana dane osobowe przetwarzane będą w celu przeprowadzenia webinarium, w szczególności:
a. rejestracji uczestników,
b. czynnego udziału w webinarium,
c. udostępniania zapisu webinarium każdemu zainteresowanemu poprzez zamieszczenie nagrania audio-wideo na portalach społecznościowych, w szczególności na profilu Facebook, Youtube oraz na stronach Górnośląsko-Zagłębiowskiej Metropolii.

4) Dane przetwarzamy na podstawie:
a. niezbędności przetwarzania w ramach realizacji zadania publicznego jakim jest rozwój społeczny i gospodarczy obszaru związku metropolitalnego oraz promocja związku metropolitalnego i jego obszaru oraz realizacja majątkowych praw autorskich w zakresie nagrania audio-wideo (art. 6 ust. 1 lit. e rozporządzenia) ,
b. interesu administratora jakim jest dochodzenia roszczeń prawnych lub obrony przed takimi roszczeniami (art. 6 ust. 1 lit. f rozporządzenia).

5) W określonych sytuacjach Pani/Pana dane osobowe mogą być przekazywane
osobom upoważnionym przez administratora danych osobowych (w szczególności pracownikom Metropolii), dostawcom usług w takich obszarach jak: usługi pocztowe lub kurierskie, wykonywanie lub dostarczanie systemów informatycznych niezbędnych do funkcjonowania Metropolii, obsługa archiwalna, portalom społecznościowym w zakresie udostępnianego zapisu z webinarium (w szczególności FB oraz YT).

Ponadto w zakresie stanowiącym informację publiczną dane będą ujawniane każdemu zainteresowanemu taką informacją lub publikowane w BIP Urzędu.

6) Pani/Pana dane osobowe będą przechowywane do wyrażenia skutecznego sprzeciwu w zakresie, którego dotyczy lub do zakończenia realizacji celów przetwarzania.

7) Posiada Pani/Pan prawo do:
• dostępu do swoich danych osobowych i informacji na temat sposobu ich przetwarzania,
• żądania ich sprostowania,
• żądania usunięcia lub ograniczenia przetwarzania,
• wniesienia sprzeciwu wobec przetwarzania w sytuacji, gdy podstawą ich przetwarzania jest art. 6 ust. 1 lit. e albo art. 6 ust. 1 lit. f rozporządzenia 2016/679.

Ponadto istnieje możliwość wniesienia skargi do Organu Nadzorczego, jak na terenie Polski jest Prezes Urzędu Ochrony Danych Osobowych, gdy uzna Pani/Pan, iż przetwarzanie danych osobowych dotyczących narusza przepisy ogólnego rozporządzenia o ochronie danych osobowych.

8) Podanie przez Panią/Pana danych osobowych jest obowiązkowe, chyba że w konkretnej sytuacji zostanie przekazana informacja, że podanie danych jest dobrowolne.

9) Konsekwencją niepodania danych osobowych, tam gdzie jest to obowiązkowe będzie brak możliwości udziału w webinarium.

10) Pani/ Pana dane będą przekazywane poza teren Unii Europejskiej. Komisja Europejska stwierdziła odpowiedni stopień ochrony (umowa pomiędzy UE a USA, tzw. Tarcza Prywatności).

Information pertaining to the processing of personal data

Pursuant to Article 13 (1) and (2) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the 2016/679 Regulation), we hereby inform that:

1) The Controller of your personal data is the Chairman of the Board at Górnośląsko-Zagłębiowska Metropolia (Chairman at GZM) with its registered office at ul. Barbary 21A, 40-053 Katowice, email address: [email protected], website: bip.metropoliagzm.pl.

2) A person to be contacted in case of processing of your personal data has been indicated - it is the data protection officer. Email address: [email protected], other telephone and address data as above.

3) Your personal data will be processed for the purpose of delivering of a webinar, and in particular for:

a. registration of participants

b. taking active part in the webinar

c. sharing the recording of the webinar to any interested party by publishing the audio and video recording in social media, particularly on GZM's Facebook profile, its YouTube channel and at GZM's website.

4) We process your personal data basing upon:

a. the necessity of processing, as part of execution of a task of public interest, i.e. the socio-economic development of the area of the metropolitan association and the promotion of the metropolitan association and its area, as well as the execution of proprietary copyright related to the audio and video recording (Art. 6 (1)(e) of the Regulation)

b. legal interest of the Controller i.e. claiming compensation or protection against such claims (Art. 6 (1) (f) of the Regulation

5) In particular situations, your personal data may be provided to other people authorized by the Controller (in particular to GZM's employees) providers of services in such areas as: postal or courier services, making or delivery of IT systems necessary for the Office to function, archival service, to social media portals within the scope of the provision available with the webinar (in particular to Facebook and YouTube). With regard to other public administration bodies, provisions of the law, relevant for a given situation, shall be the basis of the provision.

Moreover, within the scope which constitutes the public information, the data shall be disclosed to each and every party interested in such information or published in BIP [Public Information Bulletin] of the Office.

6) Your personal data shall be stored until your effective objection, to the extent such objection concerns, or to termination of implementation of the purposes of processing.

7) You hold the right to:

access your personal data and information on the manner of their processing,

demand its rectification,

demand erasure or limitation of processing,

lodge an objection to the processing if its processing basis is Article 6 (1) (e) or Article 6 (1) (f) of the 2016/679 Regulation.

Furthermore, it is possible to lodge a complaint to the Supervising Body which in respect to the territory of Poland is the President of the Personal Data Protection Office, if you find that the processing of your personal data breaches the provisions of the General Data Protection Regulation.

8) The provision of the personal data by you is obligatory unless in a specific situation, information that the provision of the data is voluntary is provided.

9) A consequence of non-provision of the personal data, where obligatory, will result in lack of possibility of your participation in the webinar.

10) Your data will be transferred outside the territory of the European Union. The European Commission has stated the appropriate level of data protection (agreement between the EU and the USA, the so called Privacy Shield).
